Effective as of 01 April 2024, Chekov Enterprise GmbH, and its subsidiaries, (collectively, “ChekovEnterprise” or “we” or “us” or “our” pr “ScantoFHIR”) have updated our Chekov Enterprise Privacy Notice for our Product ScanToFHIR.
Acceptance of Terms
By registering for an account and/or by accessing and using the services provided by “Chelov Enterprise GmbH”, (“Company”, “we”, “us”, “our”), operating the product ScanToFHIR, you are entering into a legally binding agreement with us. These Terms of Service (“Terms”) govern your access to and use of our services, software, and website (collectively, “Services”). Your registration for an account on or use of our Services constitutes your acceptance of and agreement to all of the terms and conditions in these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you are prohibited from using or accessing our Services. Your continued use of the service implies acceptance of these terms.
If you are registering for a ScanToFHIR account or are using ScanToFHIR Services on behalf of an entity or other organization, you are agreeing to these terms for that entity or organization, and are representing to ScanToFHIR that you have the authority to bind that entity or organization to these General Terms and Conditions (and, in which case, the terms “you”, “your” and “Customer” will refer to that entity or organization). The exception to this is if said entity or organization has a separate contract with “us” covering one or more accounts and use of the ScanToFHIR Services, in which case that contract will govern the ScanToFHIR Services with respect to those accounts only.
Service Description
ScanToFHIR is Software as a Service (SaaS) product that enables users (“Users”, “you”, “your”) to distribute paper surveys and transfer scanned material into FHIR format. Your use of any new features that augment or enhance the current Services, including the release of new tools and resources, shall be subject to these Terms.
User Accounts and Security
You are responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account.
Survey Content Responsibility
You as the user are responsible for the content of the survey instruments, the content of the generated PDF documents and the content of the scanned material. ScanToFHIR does not modify any generated PDF documents, but simply supplements them with a DataMatrix code in which the document template, the document identification number and the document page number are encoded.
Confidential Information
Both parties agree not to disclose confidential information to any third parties nor use such information for any purpose other than as necessary to perform under these Terms.
Service Level Agreement (SLA)
We strive to make our Services available 24/7, excluding planned downtime. We reserve the right to suspend the Services without prior notice for security reasons, system failure, maintenance and repair, or other circumstances.
Privacy Policy
By using our Services, you agree to the terms of our Privacy Policy.
Limitations
The quality of optical character recognition and the associated data processing depends on the quality of the scanned material. Resolution, orientation, smoothness of the pages, color depth, assumption of the page surface can have a strong influence on the results. To test the data processing functions of ScanToFHIR, you are provided with a free 30-day trial period in which you can check whether ScanToFHIR meets your requirements.

Payment and Renewal
Payment processing is carried out via partner Stripe, which also handles subscription renewals and associated payments. See below for more information.
Cancellation and Refund Policy
We provides a 30 day (demo) trial period for new users. During the trial period, you can use our Services without charge to understand their functionality and suitability for your needs.
Following the trial (demo) period, there are no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.
Once the trial period ends, you will need to choose a subscription plan to continue using our Services.
After the trial period, all fees are non-refundable, meaning that there are no refunds or credits for partially used periods. We treat all customers equally, so we don’t provide exceptions to this rule. This applies to monthly, annual, and multi-year plans.
You may cancel your subscription at any time. Upon cancellation, your subscription will remain active until the end of the billing cycle, and you will not be charged again.
Suspension for Non-Payment
If any fee is not paid in a timely manner, or we are unable to process your transaction using the payment information provided, we reserve the right to revoke or restrict access to your account.
